1. Acceptance

By creating an account or using Nirman Gyan OS you agree to these Terms and our Privacy Policy.

2. What Nirman Gyan OS is

Nirman Gyan OS is a facilitator and lead-exchange platform connecting buyers (home builders, architects, contractors) with verified construction-material suppliers. We are not a party to the underlying material sale, we do not take custody of goods or material payments, and we do not warrant the quality of materials, specifications or workmanship.

3. Eligibility

You must be 18 years or older, have a valid Indian mobile number, and provide accurate, non-misleading details.

4. Account responsibilities

• Keep your password confidential. You are responsible for all activity under your account.
• One natural person = one account. Multiple accounts for the same supplier business are not permitted.
• Supplier accounts must furnish a valid GSTIN.

5. Buyer obligations

• Provide truthful BOQ details and a real delivery address.
• Pay the agreed price directly to the selected supplier (off-platform for now).
• Rate suppliers honestly. Coordinated fake ratings will lead to suspension.

6. Supplier obligations

• Quote only for items you can actually deliver.
• Honour the quoted price for at least 7 days from the date the buyer locks you as the winner.
• Deliver per the agreed timeline. Repeated delivery failures will impact your trust score.
• Do not attempt to circumvent the platform to dodge slot-claim fees.

7. Paid features

• Supplier packet-unlock — 0.1% of the material opportunity value to gain quoting rights for one of 5 limited slots in that material packet.
• Buyer contact-unlock — ₹49 to reveal a single supplier's contact for an RFQ. First 3 reveals per RFQ are free.
• Buyer RFQ expansion — ₹49 to fetch a fresh batch of suppliers when the first batch did not respond.
• BOQ Smart Report — ₹79 for a downloadable cost report (independent of any RFQ).

8. Prohibited conduct

You agree not to: submit fake quotes; coordinate cartel pricing; post fake reviews; spam suppliers; scrape the platform; abuse free-reveal limits via multiple accounts; misuse buyer contact information for marketing unrelated to the RFQ; or attempt to gain unauthorised access to any system.

9. Trust & safety actions

We may suspend or terminate accounts, redact or remove content, withhold paid-feature credits and disclose information to law-enforcement based on detected anomalies, anti-gaming alerts or verified user reports.

10. Intellectual property

All platform IP — source code, design, copy and the Nirman Gyan OS marks — belongs to us. Suppliers retain IP in their inventory descriptions and any images they upload.

11. Limitation of liability

To the maximum extent permitted by law, our total cumulative liability to any user for any claim arising out of the service is capped at the platform fees that user paid us in the three months preceding the claim. We are not liable for material defects, delivery failures, price disputes between buyer and supplier, or any indirect/consequential losses.

12. Indemnity

You agree to indemnify and hold us harmless against any third-party claim arising from your content, conduct, or breach of these Terms.

13. Dispute resolution & governing law

Disputes shall first be resolved through good-faith negotiation. Failing that, disputes shall be referred to arbitration in Siddharth Nagar, Uttar Pradesh, India, under the Arbitration & Conciliation Act, 1996. Courts at Siddharth Nagar shall have exclusive jurisdiction. These Terms are governed by the laws of India.

14. Changes

We may revise these Terms by posting an updated version. Continued use after the revision indicates acceptance.
